Going through life tied to a chair!

« on: June 03, 2008, 06:54:30 PM »

I applied for a part-time job at Sears a few weeks ago.  He seemed to like me and told me he would call me to come down for a drug test.  I told him that because I have no kidney function that I don't produce urine for a test, but we could do a blood test or hair sample.  He said he would check it out.

He never called, so I called him 10 days ago.  He said the corporation hadn't decided wheather or not to spend the money on a blood test.  Hmmmmmmm?

He said he would call me.  No call.  Now I see the same job advertised "again" for the same store.

Do I take them on?  Would they be so stupid to not give me reasonable accommodations?  You would think a big company like Sears would have heard of the Disability Act.

It sucks, but I don't know if you could win against a big company like that.

Since KMart owns them, couldn't they use a KMart Pharmacy who has one of those in store doctors offices?
If you do investigate further on taking them on, keep detailed information from the begining of conversations with them. Hopefully someone can answer your question.

I think it is a violation of ADA. You might contact ACLU and see what they say.

::) Drug testing for Sears? It's not like you're driving a bus or operating a fork lift.
The guy just doesn't want to be bothered. Jerk. I'd call the head office and ask who to contact regarding discrimination.

That sure does sound discriminatory and a real kick in the teeth.  I hope you do try to take it further and get it resolved.  It's maddening though that you even should have to do that.
Good luck Rerun.

Rerun, it is up to you how far you want to take this.  It is a good opportunity to shame Sears and get some press for CKD.  I know, all you want is a part time job for some extra cash, and what you get is a hassle.  But, the fact is, more and more of us are in the work force, and we deserve to have the right to work.

Lawsuits are expensive, but going to the local news outlets is free.  If you feel up to it, you could make a very public stand.  Here you are ready able and willing to work, and Sears shuts you down.

Thinking of you,

Anna

if it were me, i'd fight. it is against ada and you can call them directly. if this is a one time thing ada basically just yells. however if this is corporate policy ada does have teeth fairly big ones. try calling the head of hr at the store and let them know what happened, then if necessary turn them into ada.

I know they won't care / will ignore me, but I found an email address and told them not to expect to see me in their store anymore because of this. They probably get hundreds of complaints a week so they probably won't even notice mine. I'm sorry this happened to you.

Thanks Deanne.  I got the job!  They emailed me that the company would provide alternative drug testing.  They cut 3 huge chunks out of my hair at the lab.  Just so you know....if you don't have hair on your head they shave your arm pits!  NO LIE!   I've had 3 hours of training and get four more this Thursday.  I hope I can do it.  I have to walk around the store for 4 hours.  Today my back is killing me.  I think that dialysis chair for 8 hours is playing havoc with my back muscles.

I'm glad I have a part-time job.  I'll be approaching people and trying to get them sign up for a free home estimate from our home improvement specialist.  Siding, windows, flooring etc.

Pray that my body can hold up, because today I couldn't do it.

I will be cheering for you----- four hours in a chair is a long time but walking around a store, seems harder--
I hope everyone is nice to you. I am nice and say no thanks until they insist and get pushy...

I love Sears ever since I went for new shoes back when I was in grade school in the 60's I always stop in when I go to the mall. I was just there. I motored around every where in my electric chair. Found what I needed too. Rerun if your back is hurting on the job go sit on one of the lawn tractors and give your pitch from there...Boxman

The Sears store here closed and K-Mart seems destined to follow. I hope they manage to recover. When I was young, all my clothes came from the local Sears catalog store.

they get thousands. sears national customer relations (used to be located near golden colorado) is now located in texas. hasn't been in chicago or hoffman estates for years. the sears tower isn't even owned by sears any longer. they just want you to think you're calling the corporate offices....who me, i'm telling tales out of school, i used to work for them. the office was outsourced, sears took it in house and moved the call center to texas, it's still there as far as i know.

Rerun,

I think it is great that sears finally came through for you.  I hope that you are able to ease yourself back into work.  I really do think that it is just a case of building up stamina.  The way my GP in Boston explained the changes that my body was going through was using a horse metaphor.  (was she hinting that I was getting to be the size of?  Or that I was a stubborn as...?) Either way, it helped me understand why I couldn't be working & playing like I used to, but that has come back now that I am fully dialyzed.  (I hope that Nocturnal is still going well for you)

When we are sick and not active, it is like a racehorse that has been kept in it's stall for months, you need to slowly rebuild what muscle and stamina that was lost, and you have to be careful when you first start out not to strain yourself.

I just hope that the extra cash will come in handy for Vegas (fingers crossed) and that you'll have a good time just getting out of the house.

Meanwhile, welcome to the working world!

My job is to approach people and ask them if they would like a FREE estimate on home improvement projects like new windows, doors, siding, heating/air or kitchen remodel.   I do my job but they want 1 lead an hour.  I'm sorry, but one week I didn't get any.  I work about 4 hours a day for 3 days.

So, I get the call today that if I can't get more leads they are going to have to let me go.  I feel like quiting but I think I'll make them fire me.  I might as well make $8.07 per hour until they do.

I got 1 lead today during the 4 hours.  That is 3 short.

I HATE when they talk statistics.  If you ask 99 people you should get 1 to say yes.  That is bull shit.  That is the same with a transplant.  You may have to wait 2 years.  Well, that means you could get called today or never.

I'm going back to Craigs List to look for another job.  I don't want to work weekends either.

If they fire you, can't you collect unemployment while you look for another job? They usually have to pay into that, so take them for what it's worth.

With the economy in such a mess, wouldn't there be fewer people doing big home improvements?  I think it would be very hard to meet their target of 1 an hour.  I'm sorry it isn't working out.  Hope your back is doing better.  :grouphug;
