I'm sure you should have been given written repremands (3) before you are fired. That is unless you were in a "trail" period, where the company is free to do as they see fit. Don't quote me on this though, I'm no attorney, just going by past experiences.

Pardon me, but here comes the manager side of me - I see your comment refers to the fact that you called out "several times".  Do you even have a clue as to what this means -when you are scheduled to work and call out-and the effects your call outs have on most importantly the patients who don't get on on time, run late the whole day? This adversely effects their transportation home -not to mention the effects on staff - they work short, rush to get patients on, etc.  All in all not a good situation.  #2 - why would you take a job that was too far to travel to?  Sorry - no sympathy here.  I ran a clinic for 13 years and I say don't let the door hit you on the way out.  You think you have problems?  Try putting yourself in that dialysis chair.

Calling off kills a clinic that is short staffed by design from Davita ROD's. When you only have a limited number of staff, and you call off, the others either have to pick up the extra work (which is difficult) or call someone in and thats hard to do too.
Ohio is a "at will" state and there is no reason needed to terminate people. I can assure you (as I have had to fire people with Gambro/DaVita) HR went over your termination with your FA and made sure that every "i" was dotted and "t" was crossed. If you go to a lawyer he will tell you that you have a great case.. just give him a couple thousand dollars up front...... You won't win... sorry.
Did they mark you "for rehire" where you can get on at a clinic closer to your home?

I, too, am a former Davita employee. I was reprimanded for requesting the same day off as my sister four months in advance. I was written up for taking my breaks with my sister after doing so for 2 1/2 years without it ever being a problem.  The very next day, the FA who wrote us up sent us to break together. I was written up for not verifying a patient's weight when it was proven to be a machine malfunction.  I can tell you from experience, this company does what it wants and it is all about the bottom line. I questioned their policy regarding three write ups, suspension, then termination.  I was told this was just a "guideline", they did not have to go by it.  Then why waste my time and theirs having me read and sign the employee handbook. The problem is Ohio is and "at will" state and a person can be terminated for no reason.  This really is not fair and needs to change.
