So I've been working to get approved for disability since I first got sick in May 2010. The stakes were high enough that I hired an attorney to give me the best odds possible in winning my case. The question was not really if I am i am disabled now (since I am now on dialysis) but if my disability goes beck to May 2010. I started dialysis in July 2011, so we are talking about 14 months difference. That's some substantial cash.
Anyway.
In December I had a court date with the Administrative Law Judge. This week, about 30 days after my court date, i received a letter from the ALJ stating that she had made her decision in my case. It was FULLY FAVORABLE, meaning she approved everything I was seeking.
What a relief. I still don't know when I'll actually see any money. But at least I know it's coming. It's been a long road. I'm glad this part is almost over.

If your going for SSD I'm pretty sure they will only go retroactive for 1 year. That may have changed but I seriously doubt it. Seems as if the government is making it harder to get than it was a few years ago with everyone up in arms about entitlements and all. That starts from the date you were awarded your case, so that would be 1 year back from your court date.

Actually, they will only go back one year from the date you first apply, even if it is determined that you were disabled before that date. They have to go back to the date you first apply by law, it's all over their website and confirmed by my attorney. Now, there is also that pesky 5 month waiting period that begins at the date you first applied also. So. I'll actually start getting paid from October 2010.
And yes, it was a big relief.

It's too bad you had to hire an attorney to get your disability, but that is fairly standard these days. I guess they're trying to discourage the frauds, but attorneys take a big slice of the small pie. I was lucky, CALSTRS approved my first application, but it was a no-brainer since I have so many issues.
