Got a question for you donors out there, although anyone can answer if you know. My donor called today and told me that his employer said that if he takes off for the transplant they can't guarantee his position. Is that legal? I thought FMLA would cover that? Any input would be :welcomesign;.

I don't know donor info, but I do know FMLA. Is the donor a member of your family? Have they been employed with their current employer for over a year and worked the required number of hours to be eligible? If the answers are yes, this WOULD be covered under FMLA. They would just need to file the proper paperwork with the employer.

He isn't a member of my family...but he has been with his company for 5 years, and he works a ton of overtime. So his hours should fall well into range.

A week before we transplanted my donor's company started lay-offs. She made it through all the layoffs during her recovery and once she returned to work she was cut after a few weeks. BUT....she was asked by the same company to move to another location and accept a different job that paid $4000 more a year! :clap; I was soooo happy and relieved for her! She's doing great! I hope your donor is overed, as he should be!

Well, found out that my friend's contractor has less than 50, so they don't all under FMLA....the saga continues!
