 Recently, I took my son to Barnes and Noble, as we normally do on occasion to get some awesome books. My son walked into the book case face first-- in the Children's section, no less, spliting open his eyebrow, and also leaving a nice welt and bruise
Now, I know my son is, like me, very clumsy! BUT, this was the kids section... and he was simply walking to put a book back. Not paying attention, talking to me, and smacked right into it. Scared me to death when I saw the blood. The employee at B&N didnt think he needed medical attention, but I thought it looked a bit deep, so I took him to the ER anyway. I was right, He ended up needing to have it glued back together. They wanted to do stitches, but decided that this would be safer; that numbing that close to his eyeball could be dangerous. Although, warned it could leave him scarred.

So, I decided to write B&N a nice letter, explaining what had happened, and suggest that they consider putting corner protectors on the shelves in the children's area. It has been nearly a week, and they have not contacted me back. I am sure they are a busy company, but you would think a matter like this would be something they would respond to fairly quickly.
I am not sure If I should take this matter any further? Normally I would shrug it off as merely an accident,  but after thinking about it, I don't want this happening to another child, when the solution is so simple. I am sure my son is not the first, and wont be the last unless they do something about it. I am not one to make a huge fuss, but when it comes to children, why not be safe than sorry?

What do you guys think I should do?

Is it possible to take your son back to the store and ask to talk to a manager? Seems like it could help if they see the injury for themselves.

they saw it when it happened.

I want to make it clear that im not trying to sue or anything ridiculous like that. i just want to keep it from happening again.
I called them today at the store where it happened. i suggested it to them. i think that is really i can do.

Honestly, until you do - they likely won't respond and they won't do a thing.  Responding would be admitting blame - and the cost of putting on bumpers on every shelf, even if only in the kids's section, on a chain-wide basis is so great, it's easier and cheaper to offer a settlement for any real lawsuits that come in.

Can you tell my paralegal training has made me cynical?

I'd just let it go.  You wrote them already and expressed your concern. Unless you have lots of time and money to hire a lawyer and pursue a lawsuit with very little cause, it's futile. But it's up to you!

noo i dont want to do that! Thats just silly. I just wanted to protect another child from that happening, and also in a way, the book store as well, because i know some parents who would sue for just about any thing they can... (which is just stupid, if you ask me... but they are among us)
