Man undergoing dialysis treatment files lawsuit after losing job

TYLER - An Anderson County resident has filed a lawsuit against his employer after he was fired because his employer allegedly did not want to accommodate his disability which required in-home dialysis each night.

Claiming violations of the Americans with Disabilities Act, which prohibits employment discrimination based on disability and perceived disability, Lance House filed suit against Palestine I Enterprises, doing business as Greenbrier Nursing and Rehabilitation Center of Palestine on May 9 in the Eastern District of Texas, Tyler Division.

House began working for Palestine Enterprises as Administrator on Aug. 14, 2007. In early March 2009, he started dialysis at the hospital and later in the month continued the treatment at home. House states he was terminated from his position on Jan. 15, 2010, because the defendant failed to accommodate his disability.

The defendant is accused of violating the ADA willfully, recklessly and maliciously.
The plaintiff is seeking damages for back-pay, reinstatement, restoration of lost benefits, compensatory damages for mental pain and suffering, emotional distress, humiliation and embarrassment, punitive damages, attorney fees, interest and court costs.

House is represented by Curtis B. Stuckey of Stuckey, Garrigan & Castetter in Nacogdoches. A jury trial is requested. A jury trial is requested.

U.S. District Judge Leonard E. Davis is assigned to the case.
