Just asking for advice here and ranting,
My roomates are suppose to be paying half the rent every month, Note that they are only occupants on the lease so instead of paying the office, they actually pay me in person. Well they do pay rent but it's whatever they feel like and sometimes they don't do it at all. I get excuses like I had to pay my car payment, car repairs, etc. This is the thing that sets me over the edge they claim that they don't have enough to be paying me half every month but yet they can go out to bars and out to eat almost every single night of the week. Uh, doesn't that stuff cost money? I also love it that they will come ask me for money claiming that they don't have any.
How is it that they can do this drinking every night but can't pay me full rent every month, I work part time and they are full time so they sure make more than I do. Sometimes do to hospitalizations I hardly make anything at all. I don't even know if I'm going to be able to pay rent next month. Aren't roomates suppose to help the person out financially therefore that's why you get a roomate in the first place? My roomates are part of my family so I'm wondering if they are just taking advantage of me. Since they are not listed on the lease as a roomate or co-signer I don't think I can do anything legally, I believe it was maybe someone on here, but I heard I can't even throw them out until the lease is up even as an occupant. Any ideas on what to do? I want to find a new roomate who is going to be better financially fit for me but if I'm stuck with this crap for a year I will just go in sain.

Sounds like you need to have a serious talk with the offender(s).
Your roommates sound like they have gotten used to not having to pay so why bother? It's low on their priority list (as opposed to going out and having a good time). Somehow you are going to have to educate them to the reality of the situation.
I don't understand why you can't kick them out. They need to pay up or move out. Period. Under NO circumstance should you be giving THEM money!

If they are not on the lease, then they have no rights there. Give them a notice to pay rent or quit, and a firm date by which they have to move out. Well, unless you like supporting other people.

If they're not listed on the lease then they have no legal rights to actually be there (I'm assuming they haven't signed any contracts or legal papers regarding the apartment?). Why do you think you can't ask them to leave if they're not paying their way? Family can be the worst people to have as 'roomies' because they know they can get away with a lot more than somebody else. Perhaps you need to draw up a form of contract with them, something which states how much they pay you, the exact day of the week/month you expect payment and anything else you require of them whilst they're living with you. It won't be legally binding, but you'll all know where you stand and failure to comply can be the reason you then ask them to leave.

In addition, most of the leases I've seen have a stipulation that you cannot have overnight guests for more than (X) consecutive days in a row. Perhaps take that angle and tell them that having them there is in violation of your lease and you've been threatened with eviction if they don't either leave or sign onto the lease? That way the pressure's off you and you're not the bad guy. If they agree to sign onto the lease then they ARE legally - not just morally - obligated to pay rent. If not, well, what can YOU do about it? Rules are rules and you can't lose your apartment. ;D

they are signed on as occupants, but that's all they are they didn't sign anything, can I still kick them out?

The lease is in your name, you are responsible, so kick their butts out!!!
