Title: dialysis and FMLA
Post by: sullidog on July 26, 2010, 06:02:14 PM
I applied for FMLA back in June for my job. They only approved it through August but did not say what happens after it runs out rather I'd have to reapply or I'd be enelgible for it until next year. I asked about this and they could not give me a straight answer just we'll burn that bridge when it gets there. For those of you who are FMLA do to dialysis, how did your company handle it?

Troy, I'll tell you what I know about FMLA, but this is California information, and California tends to modify laws to favour the employee more than most states ever do.

From what I understand, you will be paid a percentage of your salary for the first 6 weeks (up to a certain predetermined max). Then you may take an additional six weeks off without compensation and the employer must continue to hold your position for you. After that, I suspect it would be up to your employer whether to hold your job or not. If you know you're going to need beyond six weeks, you should probably look into state and fed disability. I don't know much about state, but with SSDI they will be more than happy to help you get back to work the moment you feel able.

Hope this helps. Good luck.

In NJ, you do not get paid for FMLA.  You get twelve weeks and then after that your employer can let you go.
